Florida Marriage Law, Explained
Who can officiate — Florida Statute § 741.07(1) authorizes ordained clergy, judicial officers, clerks of circuit courts, and notaries public to solemnize a marriage. No separate officiant license is needed beyond the notary commission.
Applying for your license — issued by a county court judge or clerk of the circuit court; both parties must appear together in person with valid photo ID and Social Security number. Statewide fee is $86.00.
The 3-day waiting period — waived by completing a state-approved premarital course (4+ hours within the past year), which also drops the fee to $61.00. Non-Florida residents are automatically exempt.
60-day validity window — once issued, the license is valid for 60 days; no one may perform the ceremony after that.
No residency requirement — no need to live in Florida or be a U.S. citizen to get a Florida marriage license.
The officiant's post-ceremony duty — legally required to file the signed certificate with the issuing clerk's office within 10 days; Red Tails tracks and closes this out for you.
No witnesses required — no witness requirement or mandated wording, so your ceremony can be as personal or traditional as you want.
The Marriage Flight Plan
A clear, step-by-step mission brief so nothing falls through the cracks between 'yes' and 'I now pronounce you.'
1. File your flight plan (apply for your license) — both appear together in person at any FL county clerk with valid photo ID and SSNs.
2. Consider the premarital course — erases the 3-day wait and saves $25 on the fee.
3. Confirm your license window — valid 60 days from issuance.
4. Book your officiant — lock in your Red Tails officiant and ceremony details well ahead of your date.
5. Bring the license — your officiant must see a valid, unexpired license before the ceremony begins.
6. The ceremony — no witnesses or script required, as personal or traditional as you want.
7. Sign the license — immediately after the ceremony, the certificate is completed.
8. Officiant files the certificate — Red Tails transmits your signed certificate within the legally required 10-day window.
9. State recording — the clerk records the marriage and forwards it to Florida DOH Vital Statistics.
10. You're legally married — officially, on record, no loose ends.

Full Wedding Day Coverage — starting at $500. For couples working with a planner and a full-day timeline. Includes rehearsal coordination, full ceremony officiating, on-call flexibility, and complete post-ceremony filing.
